SFCL simplification – update

As previously reported, in the interests of simplification, the CAA has proposed several amendments to Part-SFCL implementing rules that are currently being reviewed in Government ahead of an anticipated law change.

Aviation law is essentially in two layers; ‘hard law’, which as noted above is approved by the elected Government and ‘soft law’, which can be modified by the regulator, ie the CAA.

The CAA is about to consult on what are called ‘Acceptable Means of Compliance’ and associated guidance – soft law – that support the proposed hard law changes. The BGA is supportive of these changes and would encourage others to also be supportive.

Once the CAA publishes its consultation, we will supply further detail if required.
